Welcome to JobChef. These Terms of Service and End User License Agreement ("Terms", "Agreement") govern your license, access to, and use of the JobChef web application, software, APIs, and associated documentation (collectively, the "Service") provided by us.

Please read this Agreement carefully before installing, using, or registering for our Service. By installing, using, or accessing any part of the Service, you represent that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately cease all access and use of the Service.

1. License Grant and Restrictions

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the App solely for your personal career optimization purposes, subject to these Terms.

You shall not: (i) decompile, reverse engineer, or attempt to extract source code from the Service; (ii) rent, lease, lend, sell, redistribute, or sublicense the Service; (iii) use the Service to build a competing product; or (iv) bypass any authentication or security mechanisms implemented in the App.

2. AI Output Disclaimer & No Warranties

JobChef leverages artificial intelligence, including Google Gemini API models, to analyze resumes, compare them to job postings, perform automated evaluations, and draft cold outreach templates.

• No Placement Guarantee: We do not guarantee that using the Service will result in job offers, responses from recruiters, or successful career placement.
• No ATS Guarantee: Applicant Tracking Systems (ATS) use proprietary and changing parsing models. We make no guarantee that our suggestions will satisfy or bypass any particular ATS.
• User Responsibility: You are solely responsible for verifying the factual accuracy of any AI-generated outreach templates, cold emails, resume modifications, and professional communications before using, sending, or publishing them. We accept no liability for negative outcomes resulting from factual errors, hallucinations, or unprofessional phrasing in generated content.

3. User Code of Conduct & Anti-Spam Policy

You are solely responsible for how you distribute emails drafted using the Service. We enforce a zero-tolerance policy against spam, harassment, and illegal electronic communications.

A. Compliance with Anti-Spam Laws

You agree that in utilizing any emails or templates designed by the App, you will fully comply with all applicable regional and international anti-spam laws, including but not limited to:

• CAN-SPAM Act (United States): Including providing an clear opt-out option, presenting accurate routing and header information, and avoiding deceptive subject lines.
• CASL (Canada Anti-Spam Legislation): Requiring explicit or implied consent and providing identification and unsubscribe mechanisms.
• GDPR & ePrivacy Directive (European Union): Ensuring a valid legal basis or consent for sending business communications.

B. Prohibited Activities

You explicitly agree NOT to use the Service to:

• Generate and send bulk, unsolicited commercial emails ("spamming").
• Harass, stalk, threaten, or abuse recruiters, hiring managers, or any other individual.
• Deceive, impersonate, or mislead recipients concerning your identity, qualifications, or intent.
• Create, store, or transmit content that is defamatory, offensive, discriminatory, or violates the intellectual property rights of any third party.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPERS, LICENSORS, OR PROVIDERS OF JOBCHEF BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF INCOME, FAILURE TO SECURE EMPLOYMENT, REJECTION OF JOB APPLICATIONS, WORK INTERRUPTION, DATA LOSS, OR COMPUTER DAMAGE) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE, THE ACCURACY OF THE OUTPUTS, OR FOR ANY CLAIMS ARISING FROM SPAMMING OR BREACHES OF LAW BY THE USER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (IF ANY).

5. Accounts, Tokens, and Payments

Certain AI services in the App consume credits ("Tokens"). If you buy token packages, they are credited to your Firebase account. Payments are processed via standard third-party store providers. Unless required by local consumer protection laws, all token purchases are final and non-refundable.

We reserve the right to modify the credit costs for different AI operations (e.g. email draft cost, interview simulator cost) at our discretion.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. Any legal actions or proceedings arising under these terms shall be brought exclusively in courts located in Delhi, India.
